5 Legal Issues With Your Kid's Lemonade Stand - Law and Daily Life

When life gives you lemons, you can make lemonade -- but you may not be able to sell it at a lemonade stand, at least not without jumping through some legal hoops.

There is an inexplicable war on lemonade stands, as a Forbes headline so eloquently put it, and your kids are losing the battle. Giving moonshine a run for its money, many kids' lemonade stands are getting shut down.

Here are five legal issues that can potentially stand in the way of your kid's lemonade stand:

Facebook bounty hunters paid over $1 million over two years, India second biggest recipient

Social networking giant Facebook said it has paid over USD 1 million in the past two years to security researchers who report bugs on its website, with India second among recipients by country.

India, which has over 78 million Facebook users, is also second on the list of countries with the fastest-growing number of recipients of its Bug Bounty program.

A bug is an error or defect in software or hardware that causes a program to malfunction. It often occurs due to conflicts in software when applications try to run in tandem.

While bugs can cause software to crash or produce unexpected results, certain defects can be used to gain unauthorised access to systems.

Facebook said it started the Bug Bounty program a little more than two years ago to reward security researchers who report issues and to encourage people to help keep the site safe and secure.

"The program has been even more successful than we'd anticipated," Facebook said in a statement on its website.

"We've paid out more than USD 1 million in bounties and have collaborated with researchers from all around the world to stamp out bugs in our products and in our infrastructure."

The social networking major said 329 people have received rewards, including professional researchers, students and part-timers. The youngest recipient was 13 years old.

"The countries with the most bounty recipients are, in order, the US, India, UK, Turkey, and Germany. The countries with the fastest-growing number of recipients are, in order, the US, India, Turkey, Israel, Canada, Germany, Pakistan, Egypt, Brazil, Sweden, and Russia," it noted.

While the bug hunters are spread across 51 countries, 20 per cent of the bounty paid so far have gone to US-based recipients, it added.

"Our Bug Bounty program allows us to harness the talent and perspective of people from all kinds of backgrounds, from all around the world," Facebook Security Engineer Collin Greene said.

Two of the bounty recipients have taken up full-time jobs with the Facebook security team, he added.

NYC Mayor Bloomberg: More NC, SC guns used in crimes

ROCK HILL, SC (WBTV)- Are guns from other states to blame for crimes in New York City?

According to New York City Mayor Michael Bloomberg, that answer is yes and he says guns from both of the Carolinas are a major contributing factor.

?"Unfortunately it's very easy to carry a gun from one state to another and so we really do have an interest and what goes on in the rest of this country," said Mayor Bloomberg.

Mayor Bloomberg says 90% of guns used in crimes in the city's five boroughs come from out of state.

2011 statistics from Bloomberg's camp show Virginia, North and South Carolina as the top three sources for out-of-state guns.

"Despite all we do to keep our city safe, we're increasingly at the mercy of weak national gun laws and weak gun laws in other states," said Mayor Bloomberg.

One South Carolina gun dealer says he makes sure guns get into the right hands from his shop.

"If they're having problems with coming into their state, then they need to stop it at the border. It has nothing to do with the other states," Sportsman Inc. Owner Blair Wisher.

Wisher says he follows strict federal laws before selling guns, including performing national background checks.

Mayor Bloomberg is calling for other states to have tighter background checks, better reporting of lost or stolen guns and limiting the number of firearms a person can buy.

"It's pretty convenient for them to point the finger at someone else instead of pointing at themselves," said Wisher.

"To those who say stay out of our state, our answer is we'd love to. Just as soon as you stop letting guns seep into the black market land in the hands of criminals and be used to murder our citizens," said Mayor Bloomberg.

Mayor Bloomberg says there were more than 2,000 out of state guns used in crimes in New York City in 2011. That's a 4% increase from a year earlier.

Mexico: methane gas build-up, spark caused blast

MEXICO CITY (AP) Gas could have built up for decades before an explosion caused three floors of the headquarters of the national oil company to collapse, killing 37 people, Mexican federal prosecutors said Friday.

Methane gas combined with traces of hydrocarbons beneath the building triggered the explosion, the Attorney General's Office said in a statement.

Vapors from solvents used for cleaning also contributed to the blast, it said.

The office said that methane gas accumulated from fuel kept in the building by a gas company that in the 1930s used the same lot where the Petroleos Mexicanos, or Pemex, headquarters are now located. It said the gas beneath the surface could also have come from a fuel warehouse that was once there.

Methane is the main component of most natural gas used for cooking and heating.

The statement said the Jan. 31 explosion was ignited by either a mechanical or electrical spark. Investigators found an extension cord, a lamp and a plug that could have ignited the blast, it said.

The explosion earlier this year was the petroleum giant's worst disaster in a decade.

Mexico's government relies on oil revenues for about a third of its budget.

President Enrique Pena Nieto has said he will present a bill to Congress next week to allow for more private investment for the company to be more competitive.

Both Sides in GOP?s Civil War Over Obamacare Want to Put Insurance Companies Back in Charge

By Ethan Rome
Executive Director, Health Care for America Now!

The Republicans are calling each other names in a raging internecine battle over how best to blow up Obamacare and put consumers and small businesses at the mercy of the insurance companies. In an unusual week when the Republicans are at each other?s throats, they?re still on the same side in the fight that matters: They?re for the insurance industry, not us.

The Republican debate is about whether it?s a bad idea to shut down the government and disrupt the economy unless Democrats agree to defund the Affordable Care Act (ACA). This isn?t legitimate legislative dealmaking ? it?s extortion.

Sen. Lindsey Graham (S.C.) said forcing an entire government to shut down over Obamacare is a ?bridge too far.? Sen. Bob Corker (R-Tenn.) calls the idea ?silly.? Sen. Richard Burr (R-N.C.) called it the ?dumbest idea? he?s ever heard. Burr even conceded that when the fight ends and the government re-opens, ?Barack Obama is [still] going to be president.? But upstart GOP senators Rand Paul of Kentucky and Ted Cruz of Texas are slinging insults at these senators and accusing them of being political lightweights and cowards for accepting the world as it is.

?What I can tell you is there are a lot of Republicans in Washington who are scared,? Cruz said. ?They are scared of being beaten up politically.? This tough talk comes from a guy who didn?t come to Washington for any other reason than to stoke the tea party wing of the GOP and advance his own political goals.

The whole fuss started when Cruz and extremist senators Marco Rubio of Florida and Mike Lee of Utah persuaded several other Republicans to announce that they will not support continued federal spending after Oct. 1 unless Obamacare is defunded. Fortunately, some senators took some time to think it through and then withdrew their endorsements of the letter.

Obviously, Republican senators like Cruz, Rubio and Lee feel no need to govern responsibly. They seem not to like being outdone by House Republicans, who plan on Friday to vote for the 40th time to repeal the Obamacare. That sets a pretty high bar for pointlessness, and the Senate?s Republican hardliners are trying hard to catch up.

The absurd political posturing reflects a pitched battle over GOP tactics, not goals. The Republicans still are unified in their aim to repeal Obamacare and return America to the days when insurance companies could deny our care based on health status, age and gender and jack up our rates at will.

The Republican feud is also partially about presidential politics. You can?t win the GOP primary if you?re not so far to the right you?re essentially against civilization, unless you?re a plutocrat like Mitt Romney and can afford to carpet bomb every state with TV commercials. Everyone else is required to be seriously unhinged. To mobilize the GOP faithful in 2016, some conservatives believe, you have to be the real thing ? an extremist politician who?s out-of-step with most Americans for the primary and an unabashed ?mainstream? conservative for the November election. You certainly can?t be a captive of GOP ?liberals? like Karl Rove.

The feud certainly is colorful, and it?s great fun to be in the audience for the show, but it?s just a passing phase. When the Republicans are done calling each other names, they?ll work together to enable the insurance industry to inflict the worst consumer abuses on every senior, family and small business.

What the Republicans won?t do is devote any energy to collaborating with Democrats on legislation to create jobs and help the economic recovery. After all, what good would it do to make a positive difference in the lives of millions of Americans? That?s not why right-wing extremists came to Washington. They?ve got bigger plans ? for themselves.

Jamie Dupree's Washington Insider: Congress leaves until after Labor Day

As Senators headed home on Thursday afternoon, with House members ready to join them on Friday for a five week vacation, lawmakers in Congress are leaving Washington with precious few achievements to show the folks back home.

For some voters, that's just fine - they don't want Congress to do much; for others, the lack of action on major issues shows how screwed up things are in Washington, D.C.

It has been 19 years since the Congress finished its budget work by the end of the fiscal year (September 30). Neither the House nor the Senate will come close this year.

The House has passed four of the 12 budget bills.

The Senate has passed none of them.

As of Thursday afternoon, the Congress had sent only 23 bills to President Obama for his signature, the latest being a bill that rolls back a recent increase in student loan interest rates.

One thing I've talked about for years is how much less work is being done by both the House and Senate - and figures produced by one of my colleagues bears that out.

Lisa Desjardins of CNN went back through the last five years, and found that 2013 has had the least amount of Congressional activity.

For example, in 2009, the Senate met for 113 days before the August break - 24 more days than in 2013.

Think about that - basically the Senate worked five more weeks in 2009 up until this point of the year, than Senators did in 2013.

The difference in the House was 19 days - almost four full work weeks.

Seems pretty logical to me that if you aren't in Washington for work in Congress, you aren't going to get much done in the House or Senate.

The last time the Senate voted on a Friday was in March. ?

The House didn't schedule one five day work week on the floor for the entire year.

For the next five weeks, the Congress is out. Then lawmakers are back for two weeks, and then they take the next week off.

By then, it is September 30, the end of the fiscal year.

Before that date, the House and Senate must approve a temporary, stop-gap budget to keep the government running.

Or, we have a government shutdown.

Jury hears about Jackson's likeability, drug use

A look at key moments this past week in the wrongful death trial in Los Angeles between Michael Jackson's mother, Katherine Jackson, and concert giant AEG Live LLC, and what is expected at court in the week ahead:

THE CASE

Jackson's mother wants a jury to determine that the promoter of Jackson's planned comeback concerts didn't properly investigate Dr. Conrad Murray, who was convicted of involuntary manslaughter by a criminal jury for Jackson's June 2009 death. AEG's attorney says the case is about personal choice, namely Jackson's decision to have Murray serve as his doctor and give him doses of a powerful anesthetic as a sleep aid. Millions, possibly billions, of dollars are at stake.

WHAT HAPPENED THIS PAST WEEK

? Consultant Eric Briggs told jurors that projections Jackson would have earned $1 billion or more if he had lived are speculative and not supported by the singer's history of earnings for his previous tours.

? Briggs underwent grueling cross-examination with an attorney for Jackson's mother pointing out that he had billed AEG Live for more than $600,000 worth of work and had compiled only about an inch of research and a couple pages of notes.

? Michael La Perruque, Jackson's former head of security, testified that he was concerned the singer would overdose on prescription medications and he occasionally went into the entertainer's bedroom to make sure he was still breathing. He said he didn't have similar concerns when he worked for Jackson in late 2007 and early 2008.

? La Perruque recounted an incident in a Florida hotel room in 2001 or 2002 in which Jackson's children called 911 after finding their father unconscious in a hallway of their hotel suite. He said he was able to rouse Jackson before paramedics arrived and saw no signs of drugs or alcohol the singer had taken to cause the episode.

WHAT THE JURY SAW

? Briggs struggle to answer questions about his work estimating the value of Jackson's signature asset, a stake in the Sony-ATV music catalog that includes songs by The Beatles and other top-name acts. Briggs only answered the questions after being ordered to by a judge; he cited confidentiality agreements with other clients as the reason he didn't want to answer the questions.

? Survey figures that showed Jackson's popularity in the United States dropped significantly after he was accused of child molestation in the mid-2000s. Briggs said the survey stopped asking questions about Jackson's likeability after 2006 due to his low scores, making it unlikely he would have gotten an endorsement deal for his "This Is It" shows.

QUOTABLE MOMENTS

? "He fought very hard not to be dependent on these prescription medications," La Perruque said of Jackson.

? "We live in a world unfortunately where headlines impact perceptions," Briggs said, explaining why he believes that Jackson would not have been able to secure endorsement deals even though he was acquitted of child molestation charges.

WHAT'S NEXT

Jurors will continue to hear from La Perruque, who will likely recount his recollections of Jackson's relationship with his children. Jurors may also see the videotaped testimony of Jackson's younger brother, Randy.

Hamstrung: Preventing Injury ? The Health Journal: Fitness, Nutrition ...

1 Star2 Stars3 Stars4 Stars5 Stars Loading ...?Loading ...

Written by Dr. Daniel Shaye
?

The foundation of most hamstring injury prevention is warm-up.?Typical hamstring strains come during high-intensity efforts, not during a jog around the block. Be sure you?re fully warmed up before launching into a hard effort or race. In doing so, you?ll be ahead of the game by easing into your efforts.

Prevention Tips

Put it in reverse. No, I don?t mean your car?I?m referring to your body. If your run involves a track, consider reversing directions periodically. This may be an issue on a crowded track where counterclockwise is the norm, but when I do a lot of repeats on a track or course I prefer to run some of them in the reverse ?This balances out some of the stresses on the legs, especially around the curves where leaning in to fight angular momentum is normal. If you have a weaker or less coordinated direction, save your hardest efforts for the side better suited to handle the stress.

?Get strong. Weak muscles won?t serve you well in any sport. Are your extensor muscles strong enough??Try this:?lie with your thighs and legs on a bench or table, your upper torso off the table, with a partner holding your ankles. Hold your body perfectly straight. You should feel your back extensor muscles, and quite likely your glutes and hamstrings. Can you hold this position for a full minute without fatiguing your hamstrings or spinal muscles??Can you hold it for three minutes??A basically competent athlete should be able to hold this position for a full minute without excess strain. A highly fit one should be able to go up to three minutes. If you find yourself struggling, consider working your extensor muscles, both back extensors and hamstrings along with the gluteus maximus. You may also decrease your risk for back pain.

Get coordinated. Hamstrings don?t always strain because they?re weak. They may strain because the right dominates the left, or because the lateral set is weak compared to the medial pair, or because they are weak compared to the quadriceps. They may also strain because they don?t turn on when they?re supposed to, or don?t turn off enough when they need to. Hamstrings do something called ?paradoxical extension,? actively contracting along with the quads while the foot is on the ground-based portion of the running gait. Training hamstring, quads and related muscles to function efficiently and together may be called ?neurological patterning.?? Think of it as teaching the instruments of your body?s ?orchestra? to play together under the supervision of your ?conductor??your central nervous system. I especially like to train this through three exercises:? the 1-legged squat, the lunge and hip flexion exercises. The first two teach the hamstrings to function even as their antagonists are active. The last one teaches the hip flexor muscles to activate, reflexively telling the hamstrings to take a back seat as their antagonists take over. [See images under ?Hamstring-Friendly Warmups?]

Get aligned. The low back and hips relate directly to the hamstrings. A fixated or ?stuck? sacroiliac joint, for example, can inhibit normal pelvic and hip extension, causing hamstrings to have to work overtime or inhibiting them due to subtle pain signals. Dysfunction of joints in the low back, or even disc problems, can also wreak similar havoc. Get structurally aligned before launching into an exercise program that might ingrain your problems. Remember, practice doesn?t make perfect?perfect practice makes perfect.?

Hamstring-Friendly Warmups

I mentioned warm-ups earlier. No, I don?t mean do anything that takes hours, or anything too complicated. Here?s my warm-up routine, for example:

1. Move. If you?ve been off your legs before your run (in a car, or in your bed), start by just walking about or literally shaking a leg or two. Get used to the movement.

2. Neuro mobilizations. Perform some gentle neuro mobilizations of your hamstrings and the sciatic nerves (the large nerve trunks down the backs of your thighs). Sit on a step or bench and straighten out one leg, then the other a couple times. Do the same with your head and trunk slightly flexed, which will tension the nerve and hamstring a tad more. Don?t do this to excess, just enough to wake up the area and give it signals that it needs to move, freely.

Standing hamstring stretchNeuro mobilizers

?

?

3. Lunge. In a forward-facing stance, feet at shoulder width, step out with one leg in a gentle lunge stance. Then, maintaining balance and control, reach forward and brush the ground by your forward foot, followed by raising both arms overhead in an arc (it?s a nice stretch for a stiff neck and back, too). Feel the quads, the glutes, the core and the hamstrings all active throughout the motion. Then do the same on the other side. Do a little sideways movement, gently waking up the full range of muscles around hips, thighs, and ankles.

Lunges

4. Begin running?gently. ?Don?t worry about your pace for the first couple of minutes, however embarrassingly slow it may be. In fact, it may be a couple miles before you?ve hit stride and rhythm.

You?ll note that there?s not a lot of static stretching in this warm-up. The goal is to seek overall flexibility and exquisite control, not to become a stretching legend or yogi.1 Easy motion is the majority of warm-up;?and inherent in motion is some stretching. If you want to work on flexibility, do so after your run, or take a yoga class (or better yet, both).

Do what feels right for you. If what works for me doesn?t suit you, create your own routine. ?And if nothing seems to work, seek professional help?(see prior column under ?Treatment Options?).

I?ll see you on the roads and trails, my friends.

?

1? Committed to flexibility work, to the point of excess??Consider that certain forms of INflexibility (no, that?s not a typo) are correlated to improve running performance. Perhaps I?ll visit that topic in a future column.

How Jerry Jones' latest deal spurs big bucks to sports sponsorships

File: Jake Dean

Dallas Cowboys owner Jerry Jones

After AT&T signed its big naming rights deal with the Dallas Cowboys for AT&T Stadium, the sports business folks started buzzing about other big corporate names wanting to get in on the action.

"When the economy was hit hard, companies pulled back on sponsorships," Jeff Marks, managing director of Premier Partnerships, told the Dallas Business Journal. "They are now looking for amazing properties to buy brand equity and differentiate themselves."

Marks and other sports sponsorship experts spoke with the Dallas Business Journal about Dallas Cowboys owner Jerry Jones' latest win, the corporate money at stake, and how these deals impact the North Texas region in this week's cover story, 'What's in a name? Millions for the Dallas Cowboys.'

For Dallas-based telecom giant AT&T Inc., there's a lot of money at stake to differentiate the brand in a highly-competitive industry. In the first quarter, AT&T's media buy was up 27 percent year-over-year to $463 million, according to Kantar Media research.

AT&T isn't alone. Plano-based Dr Pepper Snapple Group is getting close to a deal with the St. Louis Rams to become the team's stadium soft drink partner.

With Dallas-Fort Worth being home to a number of large corporations the deals will likely continue to roll in.

Updated: Edward Snowden vs. Bradley Manning, By the Numbers

This story, originally published June 10, 2013, has been updated.

Name: Edward Snowden

Job Title: Former CIA employee currently employed by defense contractor Booz Allen Hamilton.

Age: 30

Security clearance: Snowden had access to NSA documents during the last four years as an employee of various outside contractors.

Number of documents leaked: Undetermined. Snowden leaked a PowerPoint presentation and possibly among other documents about PRISM, a government computer program used for managing foreign intelligence collected from Internet and electronic service providers.

UPDATE: Word got out via The Guardian earlier this week that he also disclosed details of the XKeyscore program. The British newspaper says that XKeyscore is the NSA?s ?widest-reaching? system, giving analysts the ability to monitor millions of Internet users? emails, online chats and browsing history.

Agency betrayed: National Security Agency

Potential years: Undetermined. Snowden is still holed up in a hotel room in Hong Kong, though he said in a video that he?s prepared for the fact that he could be "rendered by the CIA" or "have people come after me" at any time.

UPDATE: The U.S. government leveled charges against Snowden of ?theft of government property, unauthorized communication of national defense information and willful communication of classified communications intelligence information to an unauthorized person,? according to Reuters. The latter two offenses violate the Espionage Act and, if tried before an American jury, Snowden could face 10 years in prison for each of those charges. However, it?s unlikely that the U.S. will get its hands on him anytime soon. After holing up in Hong Kong in the weeks following the leak, Snowden fled for Russia. He was not allowed to leave Sheremetyevo airport in Moscow until Thursday, when he was granted a year?s asylum by the Russian government. Snowden can now live and possibly work anywhere in Russia for the next year. His lawyer told Reuters that Snowden will rent an apartment and has no immediate plans to leave.

Motive: The Guardian interviewed Snowden, who lived in Hawaii with his girlfriend and had a stable, well-paying job: "I'm willing to sacrifice all of that because I can't in good conscience allow the US government to destroy privacy, internet freedom and basic liberties for people around the world with this massive surveillance machine they're secretly building."

"The government has granted itself power it is not entitled to," Snowden added. "There is no public oversight. The result is people like myself have the latitude to go further than they are allowed to." Snowden says he hopes that his efforts will spur public debate about the intelligence programs the government is running.

Name: Bradley Manning

Job title: Army Private First Class, 2nd Brigade Combat Team, 10th Mountain Division

Age: 25

Security clearance: Manning "was allowed to surf massive closed databases of secret information without any restrictions as well as download classified files to CDs," according to The Guardian.

Number of documents leaked: Manning provided 700,000 documents to Wikileaks in the most extensive leak of confidential and classified material in U.S. history.

Agency betrayed: U.S. Military

Potential years: Government prosecutors are charging Manning with aiding the enemy, a charge that carries a maximum of a life sentence. Manning, who faces 22 charges altogether, is allowed to plead guilty to seven of them (not including the aiding the enemy charge), which together carry a maximum sentence of 16 years in prison.

UPDATE: Manning was found not guilty earlier this week of the most serious charge of aiding the enemy, but Judge Col. Denis R. Lind convicted him on six counts of violating the Espionage Act of 1917 and most of the other crimes he was charged with. Manning?s sentencing hearing began on Wednesday, and he now faces up to 136 years in prison. Prosecutors are pushing for the maximum sentence, a reduction in rank, forfeiture of pay, dishonorable discharge and a fine.

Motive: Manning became increasingly disillusioned with the Army and the U.S.?s tactics in Iraq and, during online chat sessions with Adrian Lamo, a former hacker, said that he wanted "people to see the truth? regardless of who they are? because without information, you cannot make informed decisions as a public."

Winter Olympic Sports Federations Oppose Discrimination, So Why ...

There has been a growing amount of discussion of how the Olympics may or may not be affected by the anti-LGBT laws enacted in Russia, a year before the Sochi Winter Olympic games. Should there be a boycott, to call attention to these laws and the plight of Russians who are affected by them? Would it be better to attend, compete, and (a la Jesse Owens in Berlin or John Carlos in Mexico City) use the games to make a political statement about equality and justice? (See Dave Zirin here.) Activists argue over the right strategic approach, and athletes argue about whether this would make them into pawns.

Wrestling coach Charley Sullivan described himself like this in a piece at OutSports:

I?m a college coach who has sent athletes to each of the past three summer Olympic Games, and has two actively training for the next quadrenium. I?m also a doctoral candidate in history, writing a dissertation on gender, sexuality, autocratic states and mass violence in the 20th century. And I?m an openly gay Quaker with a strong set of values about social justice.

He puts those values and that experience to good use, with a very thought-provoking piece. He is well aware of the power dynamics involved in the Olympics, from the team level to the international. One part of his writing stood out very strongly to me:

In sports where selection can be political, or where team chemistry is important, however, athletes are often loathe to make themselves an issue. Many gay, lesbian and bisexual elite athletes will, understandably, therefore, choose to just keep quiet when their own ?issue? gets increasingly hot. Instead of asking the national team coaches, high performance managers and executive directors what might (or might not) be transpiring, they will keep their heads down and keep training. Too much is at stake.

That critical voices in the discussions about potential boycott of Sochi?those of gay, lesbian and bisexual athletes aiming to compete there?will be largely absent from the debate should not be surprising then. In general, the outspoken voices will either be gay activists who may have little knowledge of elite athletics, or straight athletes and officials who may have scant knowledge of LGBT issues.

It is vital, therefore, that US sport leaders?the USOC and the heads of the eight winter sport national federations (Biathlon, Bobsled and Skeleton, Curling, Figure Skating, Hockey, Luge, Ski and Snowboard, and Speedskating)?take a forthright stand on principal.

Now. So that athletes can worry about training.

That makes a lot of sense. Sadly, we?ve gotten *crickets* from them.

But Sullivan?s piece made me wonder just who these folks are and what they believe.

Ren? Fasel is a former hockey player and referee, who moved on into dentistry as well as becoming the head of the International Ice Hockey Federation [IIHF]. Now Fasel serves as the head of the Association of International Olympic Winter Sports Federations (AIOWF), and also as a member of the Executive Committee of the International Olympic Committee (IOC). I got to thinking: what does the IIHF have to say about discrimination, equality, and justice in their bylaws?

Here?s the answer, from the preamble to the IIHF Statutes and Bylaws [pdf]:

The International Ice Hockey Federation is dedicated to the worldwide growth and development of ice hockey and In-line hockey, providing exemplary leadership and governance by diligently observing the principles of democracy, fairness, solidarity and transparency for its Member National Associations . . .

Every ice hockey player in Member National Associations of the International Ice Hockey Federation has the right to participate in a safe, positive and enjoyable environment and to be treated with respect, dignity and fairness in the process. The International Ice Hockey Federation and each of its Member National Associations do not accept and will not tolerate harassment, abuse or violence in any of its many forms, and particularly where people in positions of responsibility unfairly exercise their power and authority over others.

That?s pretty strong language. Too bad it?s in conflict with the new laws of Russia as signed by President Putin relating to LGBTs, or those of any sexual orientation who want to stand up for them. It?s certainly in conflict with the vigilante beatings and assaults that are apparently going unpunished.

And what about those other winter sports federations?

From the World Curling Federation constitution, Article 6(c) [find the document in the menu and click the download link to access)]

Any form of discrimination with regard to a Member Association, or a person, on the grounds of race, religion, politics, gender or any other harassment, is incompatible with membership of the WCF.

Not bad. It certainly seems as if a curler who wanted to wave a rainbow flag or blow a kiss to a same-sex partner in the stands would be protected from sanctions by that, if not by Russian law. Next?

International Biathlon Union [pdf], Article 1:

1.1 International Biathlon Union The International Biathlon Union (IBU) is the association of the nations of the world participating in biathlon and of other organizations interested in the sport of biathlon and sports similar to it such as roller biathlon, cross biathlon and mountain bike biathlon (summer biathlon). Through the friendly and dedicated cooperation of all the organizations, athletes and sports officials practicing the sport of biathlon, the IBU shall contribute to the creation of a peaceful world. In accordance with the principles of the United Nations, no discrimination of any country or person on the grounds of race, religion, gender or political affiliation is allowed within the IBU.

Let?s hear it for the creation of a peaceful world. Maybe Russia and its treatment of LGBTs would be a good place to give it a shot. (rimshot) Next?

The International Skating Union [ISU] [pdf], which governs both figure skating and speed skating, says this in Article 3, Section 3:

Interference

The ISU does not approve of interference in its sports based on political or any other grounds and will make every effort to avoid such interference.

On paper at least, it sounds like the ISU would not take kindly of laws that say ?your kind of people? aren?t allowed into Russia, and thus can?t compete. Next?

International Skiing Federation [FIS] [pdf]

4.1 The FIS is neutral. The FIS does not allow any discrimination of and by a National Ski Association, a club or an individual member for political, racial or religious reasons.

I?m sensing a pattern here . . . Next?

International Luge Federation [FIL] [pdf]

1.5 Purposes . . . To recognize only such luge competitions which were staged according to the Statutes and Regulations of the FIL and to guarantee that these Statutes and Regulations are observed during such competitions;

1.6.2 The FIL will not tolerate political, racist, religious, or any other discrimination towards its members.

Hmmm . . . not only will they not tolerate discrimination, but they promise to recognize only such competitions where that same standard is met. Sounds bad for Russia, if the FIL follows through on that. Next?

International Bobsleigh and Toboggan Federation [FIBT] Statutes [pdf], Article 3.7

To recognise only those competitions which comply with the Statutes and the Rules of FIBT and to ensure that those Statutes and Rules are observed at such competitions.

The FIBT Code of Ethics [pdf] goes further, spelling things out a bit more directly in section 4: Equality and Dignity

No discrimination by gender, race, marital status, religion, disability or political opinion shall be allowed in the selection and use of technical personnel, employees, collaborators, managers, or any other person who performs duties in either an operational or representative capacity. Individual dignity must always be safeguarded, and no form of discrimination or harassment shall be permitted. Likewise, in the preparation of elections or appointments, no discrimination of any type shall be tolerated. The same principle must apply to any sporting regulation.

Dignity is in, and discrimination AND harassment are both out?

I?ve got to say, it?s not looking good for Sochi here, if these winter sports federations decide to live up to their own constitutions, bylaws, and codes of ethics.

And then there?s the language from chapter 1, rule 2 of the Olympic Charter that describes the role of the IOC itself (with emphasis added):

The mission of the IOC is to promote Olympism throughout the world and to lead the Olympic Movement. The IOC?s role is:

1. To encourage and support the promotion of ethics in sport as well as education of youth through sport and to dedicate its efforts to ensuring that, in sport, the spirit of fair play prevails and violence is banned;
2. To encourage and support the organisation, development and coordination of sport and sports competitions;
3. To ensure the regular celebration of the Olympic Games;
4. To cooperate with the competent public or private organisations and authorities in the endeavour to place sport at the service of humanity and thereby to promote peace;
5. To take action in order to strengthen the unity and to protect the independence of the Olympic Movement;
6. To act against any form of discrimination affecting the Olympic Movement;
7. To encourage and support the promotion of women in sport at all levels and in all structures with a view to implementing the principle of equality of men and women;
8. To lead the fight against doping in sport;
9. To encourage and support measures protecting the health of athletes;
10. To oppose any political or commercial abuse of sport and athletes;
11. To encourage and support the efforts of sports organisations and public authorities to provide for the social and professional future of athletes;
12. To encourage and support the development of sport for all;
13. To encourage and support a responsible concern for environmental issues, to promote sustainable development in sport and to require that the Olympic Games are held accordingly;
14. To promote a positive legacy from the Olympic Games to the host cities and host countries;
15. To encourage and support initiatives blending sport with culture and education;
16. To encourage and support the activities of the International Olympic Academy (IOA) and other institutions which dedicate themselves to Olympic education.

Later on, the Olympic Charter talks about the symbols of the Olympics ? the flag, the interlocking rings, etc. ? and their use. Section 4.10.4 is rather important:

The use of an Olympic emblem must contribute to the development of the Olympic Movement and must not detract from its dignity; any association whatsoever between an Olympic emblem and products or services is prohibited if such association is incompatible with the Fundamental Principles of Olympism or the role of the IOC as set out in the Olympic Charter.

I?d say that harassment, beatings, threat of arrest, and imprisonment or expulsion from the country qualify as ?incompatible? with promoting peace and acting against discrimination, wouldn?t you?

Every single one of these sport federations has on their books non-discrimination statements of one kind or another. Some, like the IIHF, are much stronger than others like the ISU, but all of them have at their core a belief that those who compete should not face sanction or discrimination or beatings or arrest based on who they are or what they believe.

The silence from the heads of these federations is deafening. What would it take, I wonder, for Ren? Fasel to speak up on behalf of hockey players who are gay or who stand up for their gay colleagues, or for the fans of hockey who are opposed to discrimination and gay-bashing? Fasel wouldn?t even have to write a speech ? he could just read from the IIHF?s constitution:

Every ice hockey player in Member National Associations of the International Ice Hockey Federation has the right to participate in a safe, positive and enjoyable environment and to be treated with respect, dignity and fairness in the process.

By that measuring stick, Sochi has absolutely no business hosting the Ice Hockey portion of the 2016 Winter Olympics.

None. At. All.

And if Fasel & Co. start speaking up, maybe the mayor of Vancouver would make an offer to the IOC that they couldn?t refuse, with one simple message: Move the Games.

Now.

Twitter search upgraded with photo results, recent query suggestions

In case you haven't noticed, text-based search results simply don't cut it anymore -- users are looking for people, pictures and social context. Naturally, Twitter is keeping up with the times, updating its own search bar with socially aware suggestions, previous search data and more robust results. The general search experience hasn't changed, of course, but the changes do tweak the experience for the better.

Suggested accounts, for instance, are now underlined by users you know that follow them, and simply leaving your cursor in the search field offers a preview of recent and saved searches. Results have more meat too, offering tabs for matching users and photos, as well as displaying them within the standard results stream. A revolution in social search algorithms? Probably not, but it should make it a little easier for you to keep up with the latest celebrity gossip.

Dinosaurs had 'flight-ready' brains

Several ancient dinosaurs evolved the brainpower needed for flight long before they could take to the skies, scientists say.

Non-avian dinosaurs were found to have "bird brains", larger than that of Archaeopteryx, a 150 million-year-old bird-like dinosaur.

Once regarded as a unique transition between dinosaurs and birds, scientists say Archaeopteryx has now lost its pivotal place.

The study is published in Nature.

A recent discovery in China which unveiled the earliest creature yet discovered on the evolutionary line to birds, also placed Archaeopteryx in less of a transitional evolutionary place.

Bird brains tend to be more enlarged compared to their body size than reptiles, vital for providing the vision and coordination needed for flight.

Scientists using high-resolution CT scans have now found that these "hyper-inflated" brains were present in many ancient dinosaurs, and had the neurological hardwiring needed to take to the skies.

This included several bird-like oviraptorosaurs and the troodontids Zanabazar junior, which had larger brains relative to body size than that of Archaeopteryx.

This latest work adds to previous studies which found the presence of feathers and wishbones on ancient dinosaurs.

"Archaeopteryx has always been set up as a uniquely transitional species between feathered dinosaurs and modern birds," said lead author Amy Balanoff, of the American Museum of Natural History and Stony Brook University.

By studying the brains of closely related dinosaurs, she said that Archaeopteryx "might not have been so special".

"Large forebrains are typically correlated with things like increased cognition and parental care of the young, while not flying, they were definitely doing other things with these enlarged brains.

"A lot of these characteristics that are distinctive within birds evolved much earlier in the history of Theropods . It's interesting that the brain followed this pattern as well. The large brain evolved before flight earlier than was previously thought," Dr Balanoff told BBC News.

Continue reading the main story

Other ancient birds

Epidexipteryx - a very small feathered dinosaur discovered in China and first reported in 2008 (above). It had four long tail feathers but there is little evidence that it could fly.

Jeholornis - this creature lived 120 million years ago in the Cretaceous. It was a relatively large bird, about the size of a turkey. First discovered in China, and reported in 2002.

Sapeornis - lived 110 to 120 million years ago. Another small primitive bird about 33 centimetres in length. It was discovered in China and was first reported in 2002.

Xiaotingia, a chicken-sized dinosaur which dates back 155 million years to the Jurassic Period, reported in 2011.

Aurornis, which means "dawn bird" lived about 160 million years ago, about 50cm tail to beak reported in China in 2013.

By compiling CT scans, the scientists created 3D reconstructions of dinosaur skulls as well as modern bird brains. They also calculated the total volume of each digital brain and determined the size of major anatomical regions such as the olfactory bulbs, cerebrum, optic lobes and cerebellum.

"The story of brain size is more than its relationship to body size," said co-author Gabriel Bever, of the New York Institute of Technology.

"If we also consider how the different regions of the brain changed relative to each other, we can gain insight into what factors drove brain evolution as well as what developmental mechanisms facilitated those changes."

Adrian Thomas at the department of zoology at Oxford University, who was not involved with the study, said the picture now is much more complicated than "dinosaurs couldn't fly and Archaeopteryx could".

"There were a whole group of more or less distantly related feathered dinosaurs, some were gliding down from trees, some were flapping, and it all seemed to be happening at the same time.

"Rather than a straight [evolutionary] path that led Archaeopteryx to birds, the picture now is that there were lots of dinosaurs exploiting the advantages of gliding and flight. The birds are the ones that carried on successfully to the present day," Prof Thomas told BBC News.

But he added that the "processing power required for flight is relatively simple" compared to walking and running.

"So it is interesting, but not a great surprise, to see increased brain size in these dinosaurs associated with their highly agile lifestyles."

How to keep your cookout safe from foodborne illnesses

?

Potato salad, grilled corn on the cob and a side of salmonella. Nothing spoils a summer cookout more than an afternoon of vomiting and a midnight run to the emergency room.

The U.S. Centers for Disease Control and Prevention (CDC) estimates that 48 million Americans develop foodborne illness each year. Of those, 128,000 require hospitalization and 3,000 die. Summer barbecues and picnics are prime breeding grounds for germs, but it doesn?t have to be that way.

In most cases, foodborne illness is easily preventable. A few simple precautions can help keep your family and friends safe and healthy?and coming back for more.

Avoid Cross Contamination

Raw meat contains harmful bacteria that can contaminate surfaces and other foods. Always keep raw meat and poultry away from produce and other ready-to-eat foods. Use different dishes and utensils for raw and cooked meats. Any juices from meat should be cleaned up immediately.

During food preparation, clean countertops, cutting boards and utensils often, especially after handling raw meat.

Sing Happy Birthday

Once your hands are contaminated, it doesn?t take long to spread germs around. You touch the refrigerator door handle, touch a tomato, and before you know it, somebody is sick. It?s not enough to wash when you begin food preparation. Wash your hands often, especially after handling raw meat.

To really tackle those germs, wash your hands for at least 20 seconds. That?s about as long as it takes to sing the ?Happy Birthday? song twice.

Soap and water is best, but if you?re going to be outdoors without access to a sink, bring disposable hand wipes. That?s especially important after using a portable toilet. Hand sanitizer containing at least 60 percent alcohol won?t completely eliminate germs, but it will kill many. Follow label instructions.

Do Not Enter: Temperature Danger Zone!?

If you don?t have a food thermometer, buy one. It?s well worth the investment to ensure that your food doesn?t linger in the ?temperature danger zone? of 41-140 degrees Fahrenheit. Bacteria thrive in those temperatures.

?Any food that remains in the temperature danger zone for more than two hours should be discarded,? says ServSafe Certified Registered Dietitian Samantha Hauswirth.?

When serving outdoors in temperatures above 90 degrees Fahrenheit, food should never sit out for more than one hour.?

Keep Your Cool and Turn Up the Heat

Keep cold foods at 40 degrees Fahrenheit or below. Coolers should be kept out of direct sunlight and opened only when necessary.

?When prepping cold foods, such as pasta salad, it?s beneficial to have designated dishes for the finished product,? says Ms. Hauswirth. ?This will make refrigerator storage fast and easy so you can keep food safe until it?s ready to be served.??

Refrigerate leftovers promptly. The longer you leave them sitting around, the more you encourage growth of harmful bacteria.

?When grilling meat, an internal temperature of 165 degrees Fahrenheit will kill most bacteria,? advises Hauswirth.

Don?t let hot foods cool off; keep them hot until you?re ready to serve.?

When In Doubt, Throw It Out?

No matter how tasty that fresh garden salad looks, if you saw it hanging out with a raw chicken breast, do yourself and everyone else a favor and get rid of it.?

When you?re a guest and you see unsafe food practices, pull the host aside explain your concerns. A minute of embarrassment might prevent a roomful of people from getting sick.?

In Case You Didn?t Know?

Bacteria can live on the outside of melons and other produce. Slicing into them can transfer bacteria to the inside. Always wash fruit and veggies thoroughly before cutting.

Foods should be marinated in the refrigerator, not at room temperature.

A full cooler will keep food safe longer than one that is partially filled, but don?t just plop food on top of ice. Instead, surround food with ice.

An afternoon of fun with family and friends beats checking into the hospital any day. Follow safe food handling practices when you fire up the grill or pack that picnic basket?and let the summer fun begin.?
